From the Executive Director

BioSP met recently with a large pharmaceutical company where we discussed our assistance to idea-stage technologies and companies, and our goal of helping them to reach the next level of commercialization.

We heard that in the pharma world, there will be increasing interest in a next level of commercialization that consists of one or more vetted development opportunities with minimal corporate trappings.

Life sciences entrepreneurship is changing. BioSP is, too. While we continue to believe that bridging good science and good business, and our focus on the basics at the technology transfer, scientific founder and first-time entrepreneur level are central to the commercialization process, we're also reaching out to the many players in our sector. We're telling our story, listening to theirs, looking for ways to actively collaborate in growing our life sciences cluster.

USPTO Update from Saul Ewing
The USPTO has very recently modified their procedures relating to patent term adjustment. Following the recent Wyeth decision, the USPTO is providing patentees with the ability to request a recalculation of their patent term adjustment without a fee or petition. Per the recent decision, an applicant is entitled to patent term adjustment if certain actions were not taken by the USPTO during the examination and issue process within specified time frames; or if the USPTO fails to issue a patent within three years of the actual filing date of the application; or for delays due to interference, secrecy order, or successful appellate review. This procedure is available solely for alleged errors in view of the recent judicial decision. For alleged errors that fall outside the purview of the recent decision, the process remains as prescribed by the USPTO.

The USPTO will be processing recalculation requests via a procedure that is available to a patentee whose patent issues prior to March 2, 2010, and who requests it no later than 180 days after the issue date.  Patents issuing after the March 2, 2010 date will have a patent term adjustment calculation that is consistent with the recent decision.
